What BFCSA Does...

BFCSA investigates fraud involving lenders, spruikers and financial planners worldwide.  Full Doc, Low Doc, No Doc loans, Lines of Credit and Buffer loans appear to be normal profit making financial products, however, these loans are set to implode within seven years.  For the past two decades, Ms Brailey, President of BFCSA (Inc), has been a tireless campaigner, championing the cause of older and low income people around the Globe who have fallen victim to banking and finance scams.  She has found that people of all ages are being targeted by Bankers offering faulty lending products. BFCSA warn that anyone who has signed up for one of these financial products, is in grave danger of losing their home.

BFCSA: Australia breaks U.N. convention: Victims of bank crime and abuse of power

Dear members

When my wife and I started this quest for justice John Howard and Peter Costello had the top jobs.  Since then we have had a merry go round of P.M.'s and Federal Treasurers and this could change again pending the outcome of the September election.

Since 2007 one thing has not changed, the leadership of both parties will not acknowledge there is a systemic problem in the Australian financial sector. ASIC denies there is a problem yet both parties leadership know from internal information a problem exists, I even have a copy of a letter where Tony Abbott made representation to the Attorney General on this very matter for a BFCSA member in his electorate. Everyone on this site has been pleading with our politicians and regulators for justice with no response at the top.

As citizens of a democratic country we have been denied the basic fundamental right to justice. Australia as a state member of the United Nations and recently granted a temporary seat at the table with the big boys.  Australia is in fact in breach of a U.N. principle:  a General Assembly Resolution 40/33 of 29 November 1985, The Declaration of Basic Principals of Justice for Victims of Crime and Abuse of Power. If you google this it will give you the full run down, also scroll down to the title with Australia mentioned for the government and the Attorney General not protecting citizens.

The international community agreed in 1985 for the following rights for victims of crime;

The right to be treated with respect and recognition;

The right to be referred to adequate specialists services;

The right to receive information about the progress of the case;

The right to be present and give input into the decision making;

The right to council;

The right to protection of physical safety and privacy;

The right of compensation from both the offender and the state;

The above is published by the United Nations Dept. of public information dpi/2008/ac February 2000.

There is a lot more on this site to digest but because ASIC has decriminalized fraud in the banking sector in Australia.  What is the U.N. interpretation of it?  If only ASIC, FOS and COSL as well as the Australian Government could genuinely abide by these guidelines above.

Also for your consideration the U.N definition of a victim of crime as:-

Victims means a person who or collectively, have suffered harm, including physical or mental injury, emotional suffering, economic loss or substantial impairment of their fundamental rights, through acts or omissions that are in violation of criminal laws operative within member states, including those laws proscribing criminal abuse of power. Would the P.M. and Foreign Minister like to answer to the U.N. on this one?  IF we all write to the United Nations on these violations, the global media may want to listen in.    Thanks Neil T.

    Dear members
    I forgot to mention as well as the Senate Committee , maybe we should make submissions to the U.N. If we are denied our fundamental rights in Australia, let the world be our judge and jury.

    Great post, Neil.
    What a long journey it has been for you and your wife!
    You'd have to be asking why it's so difficult to get a fair go in this country.
    Australia, as I understand it, never signed the UN Convention on Human Rights.
    Thus, as Australians, we have no automatic Human Rights ... unless Canberra has made a "policy change" in regard to this as well?
    Last time I checked this out, it was clear that any "rights" must be defended at Law in Australia.
    I hope I'm wrong - if I am please let me know.
