BFCSA: ADELAIDE BANK decides to stick knife in and bankrupt me!

Well looks like the Adelaide Bank is going to bankrupt me on the 22/09/14. I was served with  a notice just now saying this is what is going to happen. I dont know what to do. This was with FOS then they determined that this was better dealt with through COSL > tried to stop this from happening but FOS said there was no appeal on this and it had already been done. I have not heard from COSL at all until last Friday I got a voice mail to contact COSL , up until 4pm today I haven't been able to get anyone to answer. I have left several voice mail messages for this Nicola person.

I would think that my complaint with FOS was about the Adelaide Bank, and now FOS have said that this complaint is really about Barnes Home Loans that the Adelaide Bank goes straight in now and there doesn't seem to be anything I can do.

We all need to gather together about this.  What about a PROTEST OUTSIDE ASIC in every capital city?  Anyone up for one hour of posters and protests the old fashioned way - similataneously?  We need to FIGHT FOR ROYAL COMMISSION into these crooked bankers.  Please help.

Please don't think I am interfering but when you say a notice do you mean court documents indicating a date to appear? served by a process server. Can you go to court? Is there any point of you defending the bankruptcy proceedings. Was this over a deceitful loan or have you unfortunately gotten yourself into financial difficulties.? Bankruptcy though distasteful to us all is not the end of the world for you. If you have no other options and your financial situation is not going to get better then it may be better to just go with the flow. Nasty I know. I don't know about COSL and the conditions they operate under but I know if you are bankrupt then any court proceedings do not go ahead because of the bankruptcy, which maybe a sneaky way the Adelaide Bank are operating.

Adelaide Bank and the CBA are running neck to neck, it's just that no whistleblower has come forward
with evidence of corruption within Adelaide bank of crooks.
Westpac is the same, we need internal whistleblowers, that's why we need a Royal Commission.

You can be rest assured of one thing which consistently comes out of people's complaints to COSL and FOS and that is that neither agency seems to have any interest in the complainant or the case they are presenting no matter how conclusive the evidence. I complained time and time again to COSL about a matter which had, on the surface, smelt of a systemic form of corrupt activity by two Mortgage Managers. The more the incompetent staff member attempted to close my file the more I was able to delve and bring more information out for her to consider. Eventually she did manage to close the file and I was left with nowhere else to go. In my closing response to COSL I did ask for information regarding a review process. I came across the 'Charter' which is supposedly their governing set of rules. I was astounded when I read it, they (COSL) had not abided by any of them. I took the matter to ASIC but they apparently could not or would not assist.
Rob, can I just suggest, if you speak to someone on the telephone please confirm the content of the phone call by way of an email directly to them ASAP and please log anything you do or attempt to do in your diary as well. Then park the email in a folder and an external storage system for safekeeping. It is amazing what information I have to hand if and when I can ever get someone to look at it.
I was eventually taken down the bankruptcy path and while its not pleasant to think about, at least I can sleep at night now. I know you will 'beat yourself up over this' everyone who has gone down this path does, but bankruptcy may well be your best option. I am fortunate in that I have the support of a great family and many good friends and that certainly helps. My other advantage is that I have been able to read and understand the relevant legislation which has been most beneficial in understanding not only my obligations under that Act but also my entitlements - it is not a one way street. Initially I kept believing that I was a failure, that my life's work had come to nothing, then I started to realise that, hey, I am honest, I have never set out to rip anyone off and that something good will come of this sometime. I think, for me it has, I have another perspective on life and other opportunities seem to have presented themselves to me.
As for the EDR's (COSL and FOS) and ASIC they were a complete waste of time and the sooner they completely disconnect from the lending institutions and their agents the better everything will be for everyone. There really was no transparency in any of the investigations they conducted into any of the allegations I put to them, particularly COSL.

Agree TJ the EDR's are the bank's servants not ours. and although they buy us time and keep the wolves from the door, the reality is that those wolves will eventually move in as it was all well planned from the beginning. It's just prolonging the inevitable and that's why we must have a Royal Commission with great urgency.

Are you saying setup that no matter how much we fight to save our homes that it is to no avail, the banks will take our home anyway? If this is the case why don't we just roll over and give in!!. I for one will fight for my home as I have done nothing to warrant this! I didn't intentionally commit financial suicide, some on has to pay! I am so damned angry I want justice ! COSL called me yesterday and said because I am stating that there was fraud that they wont be able to do anything! and that I should sort legal advice, how do I pay for that!! what are these people at COSL supposed to do? TJ thanks for that tip I will do that I dont trust anyone any more. TJ what happened with you house when you went bankrupt ? did they take it what happens? what is going to make me feel better about loosing everything? TJ I feel like that all the time now I feel useless, the stupid one that was taken advantage of, I cant even look at myself in the mirror without want to punch the idiot looking back at me, so I get how you feel

Rob, don't give up. We are biding time for the RC. Once it is granted all their dirty laundry will be aired and open for the whole of Australia to see the corruption within our finance and banking system and then victory will be ours, but for now we just have to work really hard at exposing the banks on all accounts. We must all stick together and put the pressure on any way we can. If there is one thing the banks are fearful of it's bad publicity. The EDR's, the banks and Asic must all be exposed for what they really are and Denise is doing a fantastic job bringing all of this to a head. Mainstream media is now coming on board and exposing much more than what they have done in the past and this is all due to Denise's and BFCSA's work. We will succeed.
