http://www.dailyreckoning.com.au/its-not-like-asic-will-save-you/2013/10/31/ ASIC, the regulator of the Australian financial system (and also the regulator of financial publishers like us), is on the receiving end of some remarkable criticism. It’s remarkable, not because of its content, but because of who it’s coming from. Usually, the customers complain about how big business shafted them. But things are so bad at the corporate regulator that even big business is up in arms.  The Australian Financial Review‘s Patrick Durkin put the story together very well. Here are our favourite bits: ‘Accounting firm BDO pointed to a specific confidential investigation they had carried out and referred to ASIC into the misconduct of an auditor which was never examined.  ‘"Despite the extensive amount of work and costs involved in conducting the investigation, there would appear to have been no action taken by ASIC to investigate the matter," BDO national audit partner Tim Kendall said..........…judge and former head of...

Bankers flee after farmer’s warning shot: police AAP MARCH 13, 2014 1:47PM       A WEST Australian farmer has been charged after bankers trying to visit his property were scared off by a rifle being fired into the air. Police said two bank representatives had tried to visit the 53-year-old man’s property, near Denmark in the state’s Great Southern region, yesterday morning when the man allegedly appeared armed at the access road with a .223 calibre rifle. He held the gun in the air and discharged a single shot, preventing both men from approaching the property, police allege. The rifle was never pointed at the victims and no verbal threats were made, police said. The bank representatives fled in their vehicle and reported the incident to police. A search warrant was executed on the man’s residence, where police allegedly found a number of firearms owned and licensed to the man....

36% of these loans were written by Bank Officers and Managers - no Broker involved.  We are sick of ASIC covering up for their banker mates and saying "the Butler Brokers did it!!!!"  Neil T writes – “Paul emailed me back, to my gratitude and said  he wasn't aware of any emails from BFCSA members  If you want us to look at this we will need some specific details but initially keep it short.’ Alan Jones Production manager reckons in an email to Neil T yesterday that he has not heard from any BFCSA members yet about how the banks have financially crippled them.  2GB needs to know what the banks are really up to?    Its up to bfcsa members to get this story out. EG. BFCSA has discovered how our Lenders  are financially crippling Aussies via their own internal Credit Assessors who are committing fraud to this day, by altering our loan...

Barbara Thomas is cancelling her bank accounts with ANZ Murwillumbah for ethical reasons.     Holding banks to account                                                                                         by Liana Turner 8th Mar 2014 UKI resident Barbara Thomas has been an ANZ customer all her working life, but now she's looking to make a move. Unimpressed with big banks investing in and lending money to fossil fuel industries, Ms Thomas is putting her money where her mouth is. "My philosophy is for the environment and social justice, not just huge money-making," she said. Ms Thomas said she was aware "ethical investing" wouldn't have the highest turnover right now, but she said growing popularity could put the industry into a growth stage. She said more people would have to change their perceptions before it was possible to abandon fossil fuels. "We need renewable energy; we need to stop fossil fuels now," she said. Australian Bankers Association chief executive Steven Munchenberg...

Will Australian Banking Scandals Rock the Economy in 2013? Written on 26 November 2012 by Dr. Alex Cowie Port Philip Publishing  http://www.moneymorning.com.au/20121126/will-australian-banking-scandals-rock-the-economy-in-2013.html 2012 has seen an impressive list of global banking scandals. The problem is that even as they get more outrageous, the market becomes more desensitised.   Apathy reigns. The real bombshell this year was the LIBOR scandal.  Some of the world’s biggest banks got caught with their pants down, manipulating the LIBOR rate. If you think that sounds boring, then know that it underpins derivatives worth over $300 TRILLION. Tweaking LIBOR a few basis points here and there can pay for more than lunch. This was a scandal so huge that it involved some of the biggest names in the banking game: Barclays, HSBC, Deutsche Bank, UBS, Credit Suisse, Soc Gen, Citibank, JP Morgan, and Bank of America, amongst many others. So global banking titans formed a cartel to deceive the...

Thousands of people's homes are being stolen by the Major Banks.  How does that help our economy?  Why do we use the word stolen?  If you intentionally set out to target pensioners known to banks as ARIP's, people who own their own home and have NO mortgage, then that is STEALING.....plotting a criminal offence.  Mature persons were told they could try this financial strategy for a couple of years.  They would initially say: "but we cannot afford to pay mortgage payments dear."   Bank Officers/Managers and their Broker agents would say: "no problem, we give you BUFFER monies to pay the payments.....we will add $100k onto the loan and you use those funds to 'afford' the payments.  Just go out and buy investment unit.....plenty for sale....we can help there too."  Then when default eventually happens 4 years later, no problem: "your equity on your home has risen and we can give...

In 2009 I spoke with FOS again and they told me they were starting to use Maladministration in Lending to deal with issues I had raised.  We told Members to state “Maladministration in Lending on all complaints where the loan was unaffordable from day one, in line with S 25.1 of the Bankers Code.”  This was pre the new NCCP  laws......why?  We had the old laws to protect consumers from predatory lending and bad lending practices such as forgery and fraud on Loan Application Forms, and Unconcionable Conduct 2001 and Maladministration in lending, and asset lending etc....................................plenty of LAWS for ASIC to play with and for FOS to use: an arsenal of weaponry against the banks and their dodgy lending products. Banks had breached the Code at all levels of approval of loans.  Most of these loans ought to have been rejected...............................hence the complaints.  Most 30 year loans would by necessity  of structure implode within 3-5 years.  But these products made...

ASIC still unable to comment on Tura Tavern finances as Financial Ombudsman prepares to take a closer look By DENISE DION Feb. 26, 2014, 7 a.m.   The collapse of Tura Pty, which owned the Tura Tavern, meant the loss of thousands of dollars for the mum and dad shareholders who had invested in the property and business through their self-managed super funds.   Investigations into the financial affairs which led to the Tura Tavern being sold at auction to Bega Valley Shire Council for $1.2 million, are believed to be continuing after ASIC the Australian Securities & Investments Commission, refused to comment on the status of the investigation. In July 2013, ASIC investigators spent a week locked in discussions with those affected by the demise of the tavern. The collapse of Tura Pty, which owned the tavern, meant the loss of thousands of dollars for the mum and dad...

Farmers launch class action against ANZ bank Sarah Taillier Updated 7 hours 49 minutes ago A group of West Australian farmers say they are planning a class action against the ANZ Bank, claiming it has engaged in 'predatory' and 'unethical' practices. In 2009, ANZ purchased Landmark's loan book, which contained rural clients. Some of those clients are involved in the class action claiming revised loan conditions, imposed by ANZ, are too harsh. The Rural Action Movement's, Greg Kenney, is one of about seven farmers behind the action. He said he hoped the case resulted in a Parliamentary inquiry into banking practices. "I wouldn't like the class action to end with just those farmers that have come on board being the beneficiaries of it," he said. "I'd like to think that once the banking practice has been made public, that the public is aware of what they've been doing, practically in the bush,...

Bank phoned me Friday just gone to say they feel after a few weeks of discussions with them that upon investigation they don't feel they acted with maladministration or were guilty of imprudent lending based on the information they received from the Broker at the time.     Pish posh...  They didn't check, or made one phone call to us, or made a request in writing to verify our figures at all. They then said we are not in the habit of contacting clients directly. Then they thought they'd be helpful  and give me COSL's contact details.   Now the Broker can't be found.   We sure as hell never had $257K as savings in the bank and I earnt a lot less than $80k per year at the time.   Not happy and not quitting.   C.E.  ...
