FAQ:   Pay payment on original loan, whilst we try to sort out the mess caused by a decade long Government neglect. The BIG POINT IS both Lenders approved the loan without checking: – truthful purpose, truthful income – had no regard for your financial well-being.  Onus is on the bank to CHECK THE AFFORDABILITY AND HAVE REGARD FOR PURPOSE OF LOAN (see Khoshaba www.austlii.edu.au)   And also Permanent/Firstmac VS O’Donnell and; KOTEVSKI(NSW); MICHAEL & KAREN COOK; SCHMIDT (VIC); KHOSHABA (NSW); van den BERGH (WA) there are others incl SA, and one we are waiting for in WA.   Otherwise an:  IMPRUDENT LEND or Maladministration in Lending…. Lenders must have regard for PURPOSE OF LOAN (to stop problem gamblers eg etc) Lenders must have regard for AFFORDABILITY and use a cost of living assessment test Lenders must have regard for FINANCIAL WELL-BEING of their customer   Also successfully argued for the victim:  The...

Well I had a call from FOS on Friday(last Friday, been a tad busy) The bloke from FOS was checking details an stuff, when I asked him "Does FOS have the power to stop summary judgment?" He replied: yes they do if the sheriffs have not gotten involved and if the Bank has not taken the house. Well I was surprised :) I can only hope they will do something by 15th Sept.. otherwise I am homeless.. :(   EDITOR: If any member in this situation on deadline contact me (or recontact me)and I will email The Ombudsman and ask for assurances This email address is being protected from spambots. Advice on how to deal with the people trying to manipulate us Refer back to 17 Techniques to Suppress Truth The Delphi Technique is a simple technique used to get 'consensus' i.e. compliance in a group so that the outcome the facilitators actually want and decided previously, can be realised  Background info on the Delphi Technique here Three steps can diffuse the Delphi Technique as facilitators attempt to steer a meeting in a specific direction. Always be charming, courteous, and pleasant. Smile. Moderate your voice so as not to come across as belligerent or aggressive. Stay focused. If possible, jot down your thoughts or questions. When facilitators are asked questions they don’t want to answer, they often digress from the issue that was raised and try instead to put the questioner on the defensive. Do not fall for this tactic. Courteously bring the facilitator back to your original question. If he...

BFCSA Members, awareness is half the problem solved, so read this and be aware of the way that truth is suppressed so easily, even when it is right under our noses!!! by DCDave Strong, credible allegations of high-level criminal activity can bring down a government.  When the government lacks an effective, fact-based defense, other techniques must be employed.  The success of these techniques depends heavily upon a cooperative, compliant press and a mere token opposition party. Dummy up.  If it's not reported, if it's not news, it didn't happen. Wax indignant.  This is also known as the “How dare you?” gambit. Characterize the charges as “rumours” or, better yet, “wild rumours.”  If, in spite of the news blackout, the public is still able to learn about the suspicious facts, it can only be through “rumours.”  (If they tend to believe the “rumours” it must be because they are simply “paranoid” or...

From my personal experience with COSL, ASIC, ACCC, Attorney General's office, and the list goes on and on, and from the posts other members are writing it seems that to some these people we are just Case number: XXXXXX or in ASIC's opinion I am not even a consumer, so they cannot help me. My question  is:  Why can't we (the ones who are able) set a date and march on the steps of ASIC, ACCC, to the state government  (just few ideas) and actually show these heartless people that we are more than a number, we have faces, we have children and family members who are suffering because of what has been done to us under their noses. This way we can attract media attention and by getting into their faces we are no longer a computer allocated number we are a human being. I struggle with the idea that...

This came from Cat Woman   I was reviewing a loan application today sent to me by one of BFCSA members and I noticed that under the personal information collection statement it clearly states that you are ENTITLED to obtain copies of any personal information collected by the mortgage insurers and it quotes GE and PMI mortgage insurers contact details. Now absolutely they would have a copy of your LAF and this SHOULD have all the lies that the banks added after it left the broker. So if your bank say that they cant find your LAF or that it has been destroyed, your mortgage insurer will be able to help you  EDITOR:  well said Cat Woman - lets test it out and see how decent these insurers are.........I would be fascinated at the responses.....send them to me  This email address is being protected from spambots. Yes, I finally made it to the bank today and made an ongoing donation to BFCSA.  I wish more Members would make ongoing donations to help BFCSA stay alive. If you want Denise to keep fighting for you, $10.00 or more a month will help. C'mon, shake the can. Write to a few philanthropists and tell them why consumers need protection from banks.  Why regulators are useless when it comes to consumer protection and why bankrupting 100,000 decent citizens and throwing them out into the streets,  is not smart Government. C'mon you letter-writers, keep up the pressure. I happen to know Denise and her Teams intend to lay into the credit card system shortly. Also Reverse Mortgages need better scrutiny.  There is so much voluntary work being done behind the scenes its really good to see.  ...

I am concerned that Denise is over-loaded. That she still has to work elsewhere part time is unacceptable. We need to help look after her. The work she is doing, as a lawyer / consumer advocate  ON OUR BEHALF would be mega bucks in professional  fees. I understand there are 400 odd members of the BFSCA? If we all gave $100 that would be $40,000 which would keep the funding going until we can get extra sponsorships etc. I totally understand that many are stretched beyond helping ( so don't feel guilty if that is you, everyone understands that and wishes you well).  But I am stretching to give an extra $100 today . Can anyone else do likewise?...

Hi all, I've noticed that some Members don't have an 'icon' at the front of our posts eg Lisa Martin has an image of the 'hand of faith' Gold Nugget she found a few years ago...(Only joking Lisa). To add a bit of colour and humour to our Blog website, I suggest that those who don't yet have a icon, that you go into Google - Images and find some gems there. eg., if you type " Trust me I'm a banker" you will get an image that you can add to your blog posts (I assure you that your children and four year old grandchildren can do it for you!). Other type in's to do when in Google Images are: "Bank Fraud", "Jailed Bankers", "White Collar Crime", "Proof of ATO Fraud".                                      ...

i just had a thought. When y'all signed your Applications do you remember taking out bank accounts to make the payments? We have two: a "mortgage account" and a "transaction account." I don't remember signing up for "bank accounts," and we certainly don't have any account application forms for those accounts or signature cards. I wonder if they got lost with our original LAF and mortgage note? With the transaction account and the mortgage account, Westpac seem to be sticking it to us both ways....

Hi All Denise works so hard and smart for us all, and now has around 30+ Members actively working spreading the word on the BFCSA and its activities. I know that there are those working behind the scenes doing great work. Others want to help, but for a host of reasons are not able to contribute as much as they wish.  However the majority, more than 700 Members are still to do their bit: - a few suggestions: Walk into your local Parliamentarians office and say "Hello" most MP's love a visit, makes them feel good.  Make an appointment for FRIDAYS as that is their "Constituency Day." Phone your local or state newspaper and give your own story, or tell them of Denise and the BFCSA. Most editors are dying to get good news.  ECHO in Midland and Northam WA is about to do an expose...... See if you can raise awareness of the...

After we have received letters from our bank in regard to calling our loan, and since finding Denise and the BFCSA we have really started to look into what the bank has lent us.  We have not recieved the full copy of the LAF and supporting documentation (as our loan was a Full Doc Loan).  We have discovered that they have lent us too much money and that our repayments alone, were $90,000 above what our income was!!!!!  No wonder we have been struggling to make the payments!!!!  They have threatened to started legal proceedings to take our properties if we do not pay out the loans on the 16th August.  Does anyone know if it is illegal to lend more than the persons income?  The say that there is no evidence of fraud as per the letter we recieved from the CEO's office: " Based on the above it is their...
